Privacy Policy (AniPlaylist App)

 

1. Scope of application 


This privacy policy describes how SASU USHIO (hereinafter referred to as “the Publisher”) uses your personal data when you use the ANIPLAYLIST application and its related services, hereinafter referred to as “the application”.
The data collected is processed by the company SASU USHIO  – 61 rue de Lyon , 75012, Paris FRANCE – SASU registered in the Trade and Companies Register of Paris on number 925 206 047.

2. List of data collected 


The Application may collect personal data from you in two ways:

  • directly, when you freely communicate your personal data to us ;
  • automatically through the technology used by the Application.
  1. The data you provide.
    Personal data collected directly from you may include the following data as well as any other type of information we expressly ask you to enter on the Application, such as:
    • Identification data, including :  
      • For Spotify accounts : Unique Spotify account ID, email address, username, profile picture, country associated with the account, access tokens allowing the creation and modification of playlists, viewing of saved tracks in the library, and adding new ones.
      • For Apple accounts : Apple account ID for the application, email address or private relay address, first and last name provided by the user, phone country.
  2. Data collected automatically. The Application automatically collects certain data relating to your use of the Application. The information collected automatically includes:
    • The IP address of your device (mobile, computer, tablet);
    • Information relating to your device, your connection mode, such as the type and version of your Internet browser, your operating system, the OS of your device, as well as the unique device identifier (“UDID”) and other technical identifiers;
    • Data relating to your activity on the Application (connections, including date and time, content accessed on the Application).

We may use and communicate this data for the purposes identified in point 3 of this privacy policy, within the limits of applicable law. 


We inform you that we may combine this data with your personal data, said combined information will then be treated by the Publisher as personal data within the meaning of Law Number 78-17 of January 6, 1978 relating to data processing, files and freedoms and in accordance with the General Data Protection Regulation of April 27, 2016. 


We would also like to inform you that we may also use automatically collected data in aggregate form for various purposes as long as said data does not allow you to be personally identified: such aggregated data will not be considered personal data.


Data relating to the management of Users' personal data is kept for the strictly necessary period as defined by the French Data Protection Act as amended.

3. Use of your personal data 


We use the personal data collected by the application for various purposes, the legal basis of which is the performance of a contract, legitimate interest or compliance with a legal obligation ;

  • To enable you to use the application
  • To provide and improve your use of the application and to provide you with any technical support
  • To notify you changes to the application ;
  • To enable you to personalize the application and to allow you to select the content you wish to have access to or to share with a third party ;
  • To contact you about the application,
  • To prevent and detect possible threats to the security of the application, fraud or any other unlawful activity, and
  • To comply with our legal obligations, solving problems and enforce our contacts.


We may also combine the personal data you provide with other data already in our databases, provided that the purpose of the existing database is ancillary to the purpose of the main processing operation and in compliance with the purposes described above.

4. The recipients of your personal data


Users’ personal data is collected and processed by the Publisher. Data may also be communicated to the Publisher’s subcontractors who act in the name and behalf of the Publisher. 


The Publisher may communicate users’ personal data in order to cooperate with administrative and judicial authorities.

Lastly, the Publisher may communicate users’ personal data to third-party service providers as part of the service provided by SASU USHIO in the context of statistical studies of the application use for the purpose of optimizing the application. In the latter case, Users personal data will be anonymized.

5. Principles relating to the collection and processing of personal data


In accordance with Article 5 of the European Regulation 2016/679, personal data shall be:

  • Processed lawfully, fairly, and transparently in relation to the data subject;
  • Collected for specified, explicit, and legitimate purposes (see Article 3.1 herein) and not further processed in a manner incompatible with those purposes;
  • Adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed;
  • Accurate and, where necessary, kept up to date. Every reasonable step must be taken to ensure that personal data that are inaccurate, regarding the purposes for which they are processed, are erased or rectified without delay;
  • Kept in a form that permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed;
  • Processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures.

The data collected by the application are gathered to ensure the proper functioning of the application. Some data, such as the user’s country or the music and albums saved in the user’s music streaming app library, may be used for statistical purposes.

6. Access to your personal data


In accordance with the applicable data protection regulations and subject to protection regulations and subjects to the conditions laid down in said regulations, you have the right to access your data, subject to providing proof of your identity:

  • Access (in particular to find out what data is processed by the Publisher);
  • Rectification (to modify data that is incorrect or no longer up to date);
  • Deletion (when you meet the conditions laid down in the Regulations and no longer wish the Publisher to process all or part of your data);
  • Portability (when you meet the conditions laid down in the Regulations and you would like the processing of your data to be suspended due to an event covered by the said Regulations);
  • To object for reasons relating to your situation (when you meet the conditions laid down in the Regulations and no longer wish your data to be processed by the Publisher);
  • To define instructions concerning the fate of your data after your death (when you meet the conditions laid down in the Regulations and wish to predetermine what should happen to your data after your death).

You have the right, at any time and without justification, to object to the processing of your data for commercial prospecting purposes, and the right to withdraw any consent given to the Publisher.

7. Retention of your personal data 


We inform you that your personal data will be retained for the following periods, based on the purposes for which it was collected:

For data collected via forms or directly through the app: Retained for a period of 13 months from the date of collection, in compliance with applicable data protection regulations.

For service contracts: Retained for a period of 10 years from the date of contract termination or expiry, in accordance with applicable legal requirements, notably for accounting and tax purposes.

For prospective customers (prospects): Retained for a period of 3 years from the last contact or interaction with the prospect, unless consent for a longer period has been obtained.

For invoices and financial documents: Retained for a period of 10 years from the end of the fiscal year, in accordance with legal and tax obligations.

For audience measurement and analytics (cookies or similar technologies): Retained for a period of 6 months from the date of collection.

For other purposes: Personal data will be retained for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required or permitted by law.

At the end of these periods, your personal data will be securely deleted or anonymized so that it can no longer be used to identify you.

8. Security of your personal data 


We use various data security measures to guarantee the confidentiality and integrity of your personal information.

The application’s database is hosted on Firebase, a service of Google Cloud Platform, a subsidiary of Google LLC.

We have activated various security rules controlling the access of the data stored in Firebase, preventing other users and non-authorized persons to access the user’s data. 

Data backup is managed by Firebase service.

9. Conditions for amending the privacy policy

The Publisher of the Application, Mr. Willy REYNO reserves the right to modify this Policy at any time to ensure its compliance with applicable law. Changes shall not affect purchases made previously on the Application, which remain subject to the Policy in effect at the time of purchase and as accepted by the user upon confirming the purchase.

Users are encouraged to review this Policy each time they use our services, without the need for formal notification.

If we change this privacy policy, we will post the revised version here, with an updated date.
